Terms of Sale

Welcome to SRT10 Athleisure Private Limited (“SRT10”, “we”, “our” or “us”). These Terms of Sale (defined below) govern your purchase of our Products (defined below) through our Platforms (defined below).
By placing an Order (defined below) to purchase the Products, you confirm that you accept these Terms of Sale and that you agree to comply with them.
To access and use our Platforms, you must meet the following conditions:
- You must be at least 18 years of age to use our Platforms independently
- If you are below the age of 18 years, you may only use our Platforms under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Sale
- You must have the legal authority to enter into a contract under the Applicable Laws and specifically into these Terms of Sale
- If you are creating an Account or using the Platforms on behalf of a company, organisation, or other entity, you must have the necessary authority to bind that entity to these Terms of Sale.
Please read these Terms of Sale carefully before ordering any Products from our Platforms.
By placing an order with us, you are deemed to have accepted and agreed to these Terms of Sale.

1. Definitions

1.1. “Applicable Laws” means all laws, statutes, rules, regulations, ordinances, and governmental or judicial orders that are applicable to your use of our Platforms and the subject matter of these Terms of Sale, including without limitation any data protection, privacy, consumer protection, or cybersecurity laws, such as the Information Technology Act of 2000 and any other relevant data protection and cybersecurity laws of India.
1.2 “Buyer” or “you” or “your” is any Registered User placing and Order through the Website and/or Platform.
1.3. “Grievance Ticket” means the unique reference number issued by SRT10 upon receipt of a complaint submitted through the channels set out on the Platforms, enabling you to track the progress of your grievance.
1.4. “Grievance Officer” means the SRT10 employee or authorised representative assigned to investigate and resolve a complaint raised by you.
1.5. “Order” means the electronic purchase of one or more Products submitted through the Platforms. 1.6 “Order Confirmation” means formal acknowledgement of Product ordered by Confirmation” means formal acknowledgement of Product ordered by you which is sent by us.
1.7. “Platforms” means the Website and any other digital interfaces or online services that we provide from time to time including applications on hand-held devices or otherwise.
1.8. “Products” means the apparel, accessories, or other items offered for sale under the Ten x You brand or any other product line we may introduce.
1.9. “Registered User(s)” means any User who creates and maintains an Account on our Platforms in order to make purchases, participate in Programs, or access additional features that are exclusive to such Users.
1.10. “User(s)” means any individual who accesses, browses, or otherwise uses our Platforms, whether they create an Account on our Platforms.

2. Offer and Acceptance

2.1. You may place Orders through our Platforms. An Order placed by you is an offer to purchase the Products specified in your Order.
2.2. A contract for sale between you and SRT10 shall arise only upon our issuance of an Order Confirmation in respect of that Order. We may, at our discretion, send an acknowledgement on receipt of your Order; such acknowledgement does not constitute acceptance unless it is expressly stated to be an Order Confirmation on your contact contract for sale between you and SRT10 shall arise only upon our issuance of an Order Confirmation in respect of that Order. We may, at our discretion, send an acknowledgement on receipt of your Order; such acknowledgement does not constitute acceptance unless it is expressly stated to be an Order Confirmation on your contact details provided to us by you.
2.3. We reserve the right, at any time and for any reason (including pricing or typographical errors, unavailability of Product, limitation of quantities, suspected fraud, payment or credit authorization failure, or any government or judicial instruction), to: (a) decline or cancel any Order (whether before or after issuance of an Order Confirmation); (b) limit quantities of Products ordered; or (c) refuse service to any person. Where we cancel an Order after payment has been taken, we will refund amounts paid in accordance with Clause 3 (Price & Payment) of these Terms of Sale.
2.4. We may process payment for and ship items in an Order separately. Where we ship Products in installments, each instalment shall be treated as a separate contract for sale subject to these Terms of Sale.

3. Pricing and Payment

3.1. Prices are quoted on the Website and/or Platforms in INR and shall be displayed at checkout page as well. Delivery and shipping charges will be added to the price and displayed at checkout, unless expressly stated otherwise.
3.2. We check prices regularly, but errors may occur. If we discover a pricing or typographical error when we receive your Order, we will contact you to confirm whether you wish to proceed at the correct price. We are not obliged to supply Products at an incorrect price.
3.3. Payment must be made by the methods available on the Platforms at the time of placing the Order. We accept the payment methods displayed at checkout. For card payments, your card issuer may undertake additional authorization and authentication; if such authorization is refused, we will not be able to accept your Order.
3.4. Where payments are processed by third-party payment processors, SRT10 is not responsible for any charges levied by such third-party processors or your card issuer for online handling or processing fees.

4. Delivery, Title & Risk

4.1. We will arrange delivery to the delivery address you provide on the Order. Delivery timeframes shown on the Website and/or Platforms or in the Order Confirmation are estimates only, and we do not guarantee delivery by the estimated date.
4.2. You are required to accept delivery of the Products at the time they are offered for delivery. If you are unavailable or otherwise fail to accept delivery, we may make up to 3 additional delivery attempts. If delivery cannot be completed after 3 attempts due to reasons attributable to you, the order shall be deemed cancelled. In such event, we may recover from you reasonable costs directly incurred in attempting delivery and storing the Products. If you request that we leave the Products with a third party or at a location other than your specified delivery address, such Products shall be deemed delivered, and we shall not be liable for any loss, damage, or misplacement of the Products thereafter.
4.3. In case Products are dispatched in instalments or separately each instalment will be treated as if covered under separate agreements. If any instalment is defective or not delivered, that will not entitle you to cancel other instalments except to the extent permitted by Applicable Law.
4.4. Title to the Products passes to you on delivery. All Products will remain the property of SRT10 until you have paid all amounts owed to us in full, including the payment of costs, earlier or later deliveries or partial deliveries. You may not sell, dispose of, or encumber any Product before full title thereof has passed to you. We take reasonable care in handling and dispatching the Products. Risk of loss or damage remains with us until the Products are delivered to you at the address provided. In the event of loss or damage in transit, we shall be responsible for resolving the issue, including replacement or refund, in accordance with Applicable Laws.
4.5. You must inspect all deliveries upon receipt and notify SRT10 of any damages to the Products within 48 hours of delivery. Failure to notify SRT10 in accordance with this Clause may affect your rights for a replacement under these Terms of Sale.
4.6 MAINTENANCE OF PRODUCTS
4.7. Please follow the washing and maintenance instructions provided on the descriptions and/or labels of the Products. We shall not be liable for any damage or deterioration resulting from improper use, care, or handling of the Products, including any deviation from the instructions provided on the labels and/or descriptions on our Platforms.

5. Returns and Cancellations

Returns
5.1. You may return purchased Products within 14 days from the date of delivery for a refund or exchange, subject to conditions given below.
5.2. To return a Product, you shall initiate a return request by website/WhatsaApp within 14 days from the date of delivery. Upon initiation of the request: (a) in most cases, our designated delivery personnel will arrange to collect the Product from the address provided at the time of delivery; or (b) if collection is not feasible in your location, you may be requested to ship the Product back to us at the address communicated by our customer support team. In either case, the Product must be returned in its original, unused condition with all tags, labels, accessories, and packaging intact, free from damage, stains, alterations, or signs of use, and accompanied by the original invoice or proof of purchase. You are responsible for securely repacking the Product to prevent damage in transit. Unless otherwise specified, you shall bear the cost of return shipping if the Product is sent back by you. Once the returned Product is received and inspected, we shall notify you of the approval or rejection of the return. Approved returns will be processed for refund, replacement, or exchange (as applicable) within 30 business days in accordance with these Terms of Sale. Returns that do not comply with this process or the conditions above shall not qualify for refund, replacement, or exchange.
5.3. The following categories of Products cannot be returned unless faulty: customised or personalised Products (including engraving or tailoring), sale/clearance items, and Products expressly described as non-returnable on the Product page.

Cancellations
5.5. You may cancel an Order, in whole or in part, at any time prior to its dispatch by submitting a cancellation request through the website/WhatsApp. You can check the status of whether your Order has been dispatched under the “My Orders” section of your account on the Platforms. Once an Order has been dispatched, it can no longer be cancelled and shall be treated as a return, in accordance with this Clause 6 (Returns and Cancellations).
5.6. We may cancel an Order in accordance with Clause 2.3 by notifying you and processing a refund in accordance with Clause 9 (Refunds).
5.7. Upon cancellation of an Order, no further obligations shall subsist between you and us with respect to the cancelled portion of the Order, except for the obligation to refund (if applicable) or process the return.

6. Refunds

6.1. Refunds are only available in the circumstances described in Clause 1 (Returns and Cancellations) or as otherwise required by Applicable Law.
6.2. Any refund will be processed within 15 days of our receipt and inspection of the returned Products. In case the refund is due to cancellation by us, refund will be processed within 7 days from the date we cancel the Order.
6.3. In case of a valid refund, we will refund the original price of the Products into the original payment method, excluding any shipping, delivery, or handling charges, in the following manner:
a. Prepaid Orders: Refunds will be processed to your original payment method within 5–7 working days (excluding Saturdays, Sundays, and bank holidays in the state of Karnataka). Cash on Delivery
b. COD Orders: You will receive a secure link via WhatsApp and email to enter your details and accept the refund through UPI or bank transfer. The refund will be processed within 5–7 working days from the date you submit the details and may take additional time to reflect in your account depending on your bank.

7. Liability

7.1. Nothing in these Terms of Sale excludes or limits SRT10’s liability for (a) death or personal injury caused by SRT10’s negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability which cannot be limited or excluded by Applicable Law.
7.2. Subject to Clause 11.1 and to the maximum extent permitted by Applicable Law, SRT10’s aggregate liability arising out of or in connection with any Order or these Terms of Sale shall be limited to the total price paid by you for the relevant Order.
7.3. In no event shall SRT10 be liable for any indirect, incidental, consequential, special, exemplary, punitive or enhanced damages, including loss of profit, revenue, business, anticipated savings, or goodwill, even if we have been advised of the possibility of such damages.

8. Indemnity

8.1. You agree to indemnify, defend and hold harmless SRT10, its affiliates, officers, directors and its agents from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms of Sale; (b) your misuse of the Products; or (c) your violation of any Applicable Law.

9. Force Majeure

9.1. We shall not be liable for delay or non-performance of our obligations under these Terms of Sale to the extent caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, strikes, governmental actions, supply chain disruptions, telecommunication failures or power outages, and we shall be entitled to a reasonable extension of time for the performance of such obligations.

10. Deposits and Pre-Orders

10.1. Where SRT10 allows deposits or pre-orders, the deposit terms will be set out at the time of order. Deposits may be non-refundable for custom or personalised orders, limited editions, or where expressly stated. Deposits are generally redeemable only by the purchaser and for the Product for which it is issued unless otherwise stated.
10.2. Where a deposit is not redeemed within 90 days, we reserve the right to cancel and refund the deposit to the original method of payment, subject to any non-refundable exceptions notified at the time of purchase.

11. Export, Resale & Prohibited Uses

11.1. Products purchased from SRT10 are for personal use only and must not be resold, exported, transferred or used for commercial purposes unless expressly authorised by SRT10.

12. Grievance Redressal

12.1. If you have a complaint relating to an Order, Product, or any other matter arising under these Terms of Sale, you may raise your grievance by writing to us on thirdumpire@tenxyou..com, or telephone at 9016201010. When you raise a grievance, you should provide the Order number (if applicable), a concise description of the issue and any supporting documents or photographs requested by our team. On receipt of your complaint SRT10 will promptly issue a unique grievance reference number (the “Grievance Ticket”) to enable you to track the progress of your complaint.
12.2. Our Grievance Officer or SRT10’s customer support team will acknowledge receipt of your complaint and provide the Grievance Ticket to you within 48 hours of receipt.
12.3. We will contact you (by telephone or email) to confirm the details of the complaint, request any further information reasonably required to investigate the complaint, and discuss potential remedial options. SRT10 will endeavour to make this contact within 7 business days of issuance of the Grievance Ticket.
12.4. SRT10 will use commercially reasonable efforts to investigate and redress the grievance within 30 days from the date of receipt of the complaint (the “Resolution Period”). If SRT10 requires additional time to investigate or resolve the complaint, SRT10 will notify you of the expected additional time and provide periodic updates until the matter is resolved.
12.5. When SRT10 reaches a resolution, SRT10 will issue a written closure communication setting out the outcome and any remedial action to be taken (for example, refund, replacement, repair, store credit or other agreed remedy). The Grievance Ticket will be closed upon issuance of the closure communication.
12.6. Subject to Applicable Law and without prejudice to any interim relief you may be entitled to seek, you may approach a consumer protection forum only after SRT10 has issued a closure communication in respect of your Grievance Ticket or SRT10 has failed to respond within the timelines set out in this clause.

13. Miscellaneous

13.1. Entire agreement
These Terms of Sale constitute the entire agreement between you and SRT10 relating to the sale of Products. They are to be read in conjunction with our Terms of Use. Any matter not addressed (including any terms that are not defined) in these Terms of Sale but covered in the Terms of Use will be governed by the Terms of Use. In the event of any conflict between these Terms of Sale and the Terms of Use, these Terms of Sale shall prevail.
13.2. Severability
If any provision of these Terms of Sale is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be severed and the remainder of the Terms will continue in full force.
